Welcome to MasterMovers Group Corporation (“MMGC”, "Company", "we", "our", "us"). These Terms and Conditions ("Terms") govern your use of our services, including our website (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

In these Terms, the terms “you” and “your” refer to any Ka-Master Merchants/Store merchants that access or use the Platform. This includes, without limitation, any organizations that enroll in or otherwise access or use the Platform through their representatives or employees (collectively referred to as “User(s)”).

The services offered by MasterMovers Group Corporation ("Services") facilitate the connection between Ka-Master Merchants ("Store Owners") and third-party delivery partners ("Delivery Partners") for the purpose of providing delivery services.

1. GENERAL PROVISIONS

MMGC, Ka-Master Merchants/Sender, and Consignee are bound by the terms and conditions of this contract, which is binding and non-negotiable. Ka-Master Merchants/Sender acknowledge ownership of the products being delivered through MMGC’s courier and hereby accept the terms and conditions on behalf of themselves or any interested party in the shipment.

The final interpretation rights and copyright exclusively belong to MMGC. No employee, agent, or other person of the company has the authority to alter, waive, or modify any provision of this contract unless expressly authorized to do so.

2. USAGE OF THE SOFTWARE

By using the company's website ("Website"), you agree to the following terms. You are permitted to access and use the Website solely on approved devices for personal use. You may not rent, lease, sublicense, distribute, or transfer access to the Website to any third parties. Probing, scanning, or testing the vulnerability of the Website or breaching any security measures is prohibited. Modifying, adapting, reverse engineering, decompiling, disassembling, or translating any part of the Website, or creating derivative works based on it, is strictly prohibited. You must not disrupt the normal operation of the Website or attempt to extract or modify its source code. Uploading or transmitting computer viruses, worms, trojans, or any malicious code is forbidden. The Website may only be used on devices running operating systems approved by the company. No rights or licenses beyond the right to use the Website are granted to you, and all other rights are reserved by the company and its suppliers. By using the Website, you agree to these terms. If you do not agree, please do not use the Website.

3. USAGE OF THE SERVICE

Ka-Master Merchant Accounts

To utilize our delivery services, you must create a personal account with MMGC. During registration and onboarding, you must provide accurate personal details as per MMGC's Privacy Policy. You agree that the information you provide is truthful, complete, and current. MMGC is not liable for any false, incomplete, outdated, or inaccurate registration information provided by you. Failure to maintain accurate information may result in your inability to access and use our Services. You are responsible for all activities conducted under your account. MMGC reserves the right to verify the information you provide at any time and may deny access to the Services without prior notice or explanation.
 

Rules of Use

Merchants warrant that they are either the owners or authorized agents of the owners of the goods and materials included in any requested shipments. They affirm their authority to initiate such shipments in accordance with their instructions. Additionally, by accepting these Terms, Merchants act not only on their own behalf but also as agents representing the owner of the shipped goods and materials, if applicable.

Merchants further warrant compliance with all laws and regulations pertaining to the nature, condition, packaging, handling, storage, and transportation of the goods and materials being shipped. They are responsible for ensuring that shipments are adequately packed to prevent damage during transmission, and that fragile items are properly protected with appropriate casing and labeling indicating their delicate nature.

Merchants must furnish all necessary information for each shipment. In cases where the recipient is absent at the specified address and no alternative instructions have been provided, the Delivery Partner will contact the Merchant using the provided contact number to arrange return of the shipment. If unable to reach the Merchant, the Delivery Partner may attempt redelivery to the recipient.

Undelivered items may be returned to the MasterMovers office if the recipient cannot be contacted and no alternative arrangements have been made. If unclaimed after 7 days (non-perishable goods) from receipt by MMGC, MMGC reserves the right to take any necessary action at its discretion. Additional handling and transportation fees for further shipments will be borne by the Merchant. Any re-transportation required will necessitate a new transportation order and associated charges.

In all cases, neither MMGC nor the Delivery Partner shall be liable for any claims arising from undelivered items due to the fault, error, or inaction of the Merchant.

4. GENERAL PROVISIONS OF THE SENDER

To secure the products during deliveries, the Ka-Master Merchants/Sender are solely responsible for ensuring that parcels are packaged properly according to MMGC's packaging guidelines. Any loss or damage arising from improper packaging is solely the responsibility of the Merchant/Sender due to packaging negligence.

Parcels shall be properly marked with the provided ORDER ID NO. of MMGC. The address and personal information of the receiver must not be marked on the parcel to maintain privacy. All information provided on the MMGC platform for booking must be accurate. In case of missing or false information provided by the sender, the sender shall be solely responsible for any necessary changes and additional fees as determined by MMGC.

The Ka-Master Merchants/Sender shall accurately declare the content and value of the package. MMGC will not be liable for compensation for any loss or damage arising from discrepancies due to inaccurate, incorrect, false, or incomplete declarations made by the Merchant/Sender as stated in the booking remarks. It is solely the responsibility of the Sender for losses or damages not covered due to inaccuracies or misrepresentation.

5. PROVISIONS FOR SENDING ITEMS

MMGC reserves the right, though not obligated, to inspect packages to ensure compliance with applicable laws. Should the sender include prohibited or restricted items without MMGC's knowledge, the sender agrees to indemnify and hold MMGC harmless from any and all damages, losses, costs, or claims that may arise as a result.

6. PROHIBITED / RESTRICTED ITEMS

MMGC strictly prohibits the delivery of certain items, including living or dead animals, human body parts, illegal drugs, weapons, ammunition, flammable materials, high-value non-aesthetic items, and other items restricted by government regulations.

The Merchant/Sender warrants that:

  • The delivery does not contain hazardous, prohibited, or restricted items such as drugs, pirated items, firearms (including airsoft and toy guns), explosives, flammable substances, organic peroxides, lottery tickets, wet ice, animals, plants, cash or equivalents (coins, currency, negotiable instruments), valuable documents (e.g., passports, visas, land titles), and valuable items (e.g., jewelry).

  • MMGC does not accept deliveries of fragile products, perishable items, or liquid products sensitive to transport conditions without explicit consent. The Merchant/Sender will be solely liable if they send these items without MMGC's knowledge or consent. MMGC is not responsible for damages to perishable, fragile, or breakable items, or for inherent damage or spoilage during pick-up, transit, or delivery.

Throughout the shipment process, parcels must comply with Philippine laws and regulations. If an item prohibited by Philippine law is detected in a shipment handled by MMGC, the company reserves the right to report the incident to the authorities and take appropriate action.

In cases where Ka-Master Merchants/Senders or consignors attempt to ship prohibited items, MMGC reserves the right to report such incidents to the relevant authorities.

7. PAYENT OF THE SERVICE

MMGC accepts payments exclusively through electronic wallets (e-wallets) for all services rendered. Cash on delivery transactions are not facilitated. By using our services, you acknowledge and agree to make payments via approved e-wallet methods supported by MMGC. This policy ensures efficient and secure transactions for all parties involved. The charges paid are typically non-refundable, unless MMGC determines otherwise on a case-by-case basis. MMGC also reserves the right to adjust charges based on actual circumstances.

8. GENERAL LIABILITY

MMGC shall not be held responsible or liable for:

  • Items damaged, defective, or changed due to improper packaging.

  • Items already damaged, defective, or changed before the delivery process begins.

  • Unconfirmed or unpaid bookings.

  • Any kind of damages, whether direct, indirect, punitive, incidental, special, or consequential, even if advised of the possibility.

Ka-Master Merchants may submit claims regarding services within 7 business days from the expected completion date of the order. MMGC reserves the right to reject claims submitted beyond this period. Claims must be submitted via email with all necessary evidence, including the item's value.

MMGC will only compensate if the Ka-Master Merchant paid the valuation fee and accurately declared the item's value. The valuation fee is 1% of the declared item value, limited to Php 15,000.

9. CLAIMS VALIDITY

Only Ka-Master Merchants are authorized to submit complaints or claims. Claims lacking complete documents or submitted after the expected delivery date will not be accepted by MMGC.

  • Claims for undelivered items to customers will be processed if submitted within 7 days from the booking and payment date.

  • Claims for items damaged due to improper handling by the rider will be accepted. However, claims for damage due to poor or improper packing by the Merchants will not be accepted by MMGC.

10. INDEMNITY

By accepting these Terms and utilizing the Service, you agree to indemnify, defend, and hold MMGC, its affiliates, licensors, officers, directors, employees, attorneys, and agents harmless from any claims, costs, damages, losses, liabilities, and expenses (including legal fees) arising from your actions. This includes any violations of these Terms or applicable laws, whether explicitly stated herein or otherwise. You acknowledge responsibility for any infringement of third-party rights, including those of Delivery Partners, and any consequences arising from your use of the Service, regardless of its appropriateness.

11. INTELLECTUAL PROPERTY OWNERSHIP

MMGC retains complete ownership and intellectual property rights over the Platform and Services, including all associated trademarks and product names. These Terms do not transfer any ownership or intellectual property rights to you. By submitting User Content, you grant MMGC a perpetual, global license to use, modify, distribute, and display the content. MMGC acts solely as a conduit for User Content and assumes no responsibility for its accuracy or legality. You are responsible for ensuring that your User Content complies with relevant laws and does not infringe upon third-party rights.

12. DISCLAIMERS

MMGC provides the Services on an "as is" and "as available" basis, without making any representations, warranties, or guarantees regarding the reliability, timeliness, quality, suitability, or availability of the Services or any services requested through them. MMGC does not warrant that the Services will be uninterrupted or error-free.

Furthermore, MMGC does not guarantee the quality, suitability, safety, or capability of third-party providers. You acknowledge that any risks associated with your use of the Services and any services or goods obtained through them are solely your responsibility, to the fullest extent permitted by applicable law. MMGC does not control third-party providers, including Delivery Partners, who are not agents, apparent agents, ostensible agents, or employees of MMGC. Additionally, MMGC does not control, endorse, or assume responsibility for any User Content or third-party content accessible through or linked to the Services. MMGC cannot guarantee that the services or servers are free of viruses or other harmful components.

13. CHANGES TO TERMS AND CONDITIONS

These Terms and Conditions may be updated periodically to reflect changes in our practices, legal requirements, or other factors. We encourage you to review these terms periodically for updates. Significant changes will be notified through appropriate means, such as posting a notice on our website or direct communication with you. Where required by law, we will obtain your consent for material updates.

MMGC reserves the right to update its Terms and Conditions in response to evolving legal, technical, or business regulations imposed by governmental authorities. We will implement appropriate measures to notify you of changes and obtain your consent for material updates as required by applicable laws. The date of the most recent update to these Terms and Conditions is indicated above. Your continued use of our website and services signifies your acceptance of any changes or updates to these Terms and Conditions. If you do not consent to modifications made by MMGC, we may be unable to provide you with access to our website and services.
